What is an Abstract and How Does it Relate to Oklahoma?

An abstract of title is a compilation of historic information concerning a tract of land based on its legal description. An abstract shows the entire chain of ownership from when the title to the property was first recognized by the government to the present. This set of documents will also include any items filed in the court clerk’s office that pertain to the land. Therefore, the abstract can be used to establish “marketable title” to a piece of property.

Terminology

Unmatured Special Assessments Certificate:

A certificate coming from the last abstract certification date that certifies as to the status of personal taxes, city liens for mowing and clearing, and securing open structures. The search is conducted by searching county clerk and county treasurers’ records for the owners’ names and the legal description.

UCC Certificate:

A certificate coming from the last abstract certification date that certifies as to any outstanding UCC Financing Statements filed through Central filing in Oklahoma County.

Special Certificate (Judgments and Liens):

A certificate based upon a 30-year search that certifies as to any outstanding judgments and liens of record, other than outstanding mortgages.

Special Certificate (Buyer Name):

A certificate based upon a 30-year search that certifies as to any outstanding judgments and liens against the buyer to a transaction.
